The Court of Appeal satisfied the claim of the prosecutor's office: land near the Dnieper again owned

The Kyiv Appeal Court granted the lawsuit of the Boryspil District Prosecutor's Office and, by a ruling dated September 16, 2025, returned two plots of land from the water fund, each with an area of 0.25 hectares (a total area of 0.50 hectares), to state ownership. They are located within the 100-meter coastal protective zone of the Kaniv Reservoir on the Dnipro River.

The court established that these lands were illegally allocated for private ownership for the construction of residential buildings and economic structures, which contradicts the requirements of the Water and Land Codes of Ukraine. Prosecutors proved that by the decision of the Tsybliv Village Council dated April 29, 2004, the plots were allocated to two citizens – 0.25 hectares each. Based on this decision, state acts for the land were issued to them in 2004.

Subsequently, in 2008, these individuals sold the plots to a third party under purchase agreements. During the further examination of the case, expert evaluations confirmed that the plots are indeed located within the coastal protective zone of the Kaniv Reservoir. Therefore, the transfer of land into private ownership occurred in violation of legal requirements and with a breach of the environmental protection regime for the use of water fund lands.

Thanks to the principled position of the prosecutor's office, the plots of land from the water fund have been returned to the state.
