The child from the surrogate mother remained an orphan, and the couple from China did not receive their child - the co-owner of the private clinic and the manager were informed of the suspicion

A newborn girl, who was born in Kyiv in May this year from a surrogate mother, is currently under state care because she has no parents. 

It has been established that a couple from China came to Ukraine to take advantage of the surrogacy program offered by a private clinic in the capital. The surrogate mother gave birth to twins for the couple – a boy and a girl.

Subsequently, in order for the foreigners to officially become the parents of the children and register them, a genetic examination was conducted. The examination established that the man is not the father of the girl; he is only related to the boy.

Knowing this, representatives of the clinic still attempted to hand over the girl to the couple, assisting them in court to establish paternity so they could take the child. Ultimately, the couple returned to China with their son born in Ukraine. The girl, however, was left by the clinic's management with a nanny in a rented apartment in Kyiv until the court issue is resolved.

It should be noted that the clinic representatives were supposed to officially transfer the child, who has no parents, to state custody, but they did not do so. Instead, their goal was to give the child to the foreigners who paid for the birth of the two children. 

Under the procedural guidance of juvenile prosecutors from the Pechersk District Prosecutor's Office in Kyiv, a suspicion has been announced against the co-owner of the private reproductive medicine clinic and the clinic manager, who attempted to give the newborn girl to the couple from China, knowing that she was not their child.

They are suspected of an unfinished attempt to traffic a minor child and illegal intermediary activities regarding the adoption of the child, by prior conspiracy of a group of individuals (Part 3 of Article 15, Part 3 of Article 149, Part 2 of Article 169 of the Criminal Code of Ukraine).

The newborn girl is in a children's institution, and law enforcement is determining who her parents are. 

The sanction of the article provides for punishment in the form of imprisonment for up to fifteen years.

In court, the prosecution will request that the suspects be remanded in custody with the possibility of posting the maximum bail provided by law. 

The pre-trial investigation is being conducted by investigators of the Pechersk District Police Department of the Main Directorate of the National Police in Kyiv, with operational support from the Migration Police Department of the Main Directorate of the National Police in Kyiv.

Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
