Prosecutors of the Odesa Specialized Prosecutor's Office in the Defense Sector of the Southern Region have approved and sent an indictment to the court regarding a former commander of one of the military units. He is accused of abusing his official position.
The investigation established that the commander, using his authority contrary to the interests of the service, allegedly relieved a subordinate soldier of his military duties supposedly to carry out his own assignments.
Instead, during this time, the serviceman was engaged in entrepreneurial activities – performing repair work in private households in the Odesa region.
To conceal the fact of the subordinate's absence, the commander repeatedly provided false information to his direct superior, claiming that the soldier was supposedly carrying out his assignments.
As a result, from December 2022 to May 2023, the soldier unlawfully received over 250,000 hryvnias in monetary support.
As a consequence, the state, represented by the military unit, suffered material losses.
The actions of the accused have been qualified under Part 1 of Article 364 of the Criminal Code of Ukraine.
The criminal proceedings have been sent to the Khadzhybei District Court for substantive consideration.
Thanks to the principled position of the prosecutors of the Odesa Specialized Prosecutor's Office of the Southern Region, during the pre-trial investigation, the accused fully compensated for the damages incurred.
The pre-trial investigation was conducted by the investigative department (located in Odesa) of the State Bureau of Investigation in Mykolaiv, with operational support from the Main Directorate of the Security Service of Ukraine in the Odesa region.
Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
