The head of the Mariinsky District Court of Donetsk region and his employees are suspected of criminal activity against Ukraine

The Office of the Prosecutor General, together with the State Bureau of Investigation, exposed the employees of the Marʼinsky District Court of the Donetsk region in organizing a scheme for the illegal avoidance of mobilization for men of conscription age.

The Acting Head of this court, the judge, and three court employees have been notified of suspicion for producing and issuing forged court decisions on fictitious divorces, deprivation of parental rights, and establishing the fact of independent upbringing of a child. Based on these decisions, men of conscription age had the opportunity to avoid mobilization and travel abroad without hindrance during martial law. 

During the investigation, it was established that an assistant judge, who previously worked in law enforcement, was seeking men of conscription age willing to obtain such court decisions. For an illegal benefit of USD 3,000 or more, the participants in the scheme ensured their approval. The assistant judge received funds from "clients" and distributed them among other participants in the scheme, including through bank accounts of related persons.

The Acting Head of the Court, the Deputy Chief of Staff of the Court, and the Registrar of Court Sessions were involved in implementing the criminal plan. They interfered with the court's automated document management system, registered non-existent claims, prepared and certified forged court decisions, and created fictitious document management to give the appearance of legality.

The Head of the court and his subordinate employees, based on the collected evidence, have been notified of suspicion, in particular: under part 3 of Art. 332 of the Criminal Code of Ukraine (illegal transportation of persons across the state border); part 2 of Art. 376-1 of the Criminal Code of Ukraine (illegal interference in the automated court document management system); part 2 of Art. 28, part 1 of Art. 366 of the Criminal Code of Ukraine (official forgery); part 2 of Art. 28, part 1 of Art. 114-1 of the Criminal Code of Ukraine (obstructing the legal activities of the Armed Forces).

Motions for the selection of preventive measures are being prepared.

The suspects face up to 9 years in prison with confiscation of property.

In addition, facts have been documented regarding the judge of this court justifying the armed aggression of the Russian Federation against Ukraine and recognizing the legality of the enemy's occupation of the Donetsk region.

In correspondence with her supervisor, she wrote: «russians will take away their territories and goodbye». «Sit in your Galicia. And in Kyiv with a non-working metro». At the same time, she denied the armed aggression of the Russian Federation against Ukraine and justified the shelling of residential buildings by Russian troops, stating that «A residential building with ordinary people and a residential building with military personnel living in it during the war are different meaningful loads».

She has been notified of suspicion under part 3 of Article 436-2 of the Criminal Code of Ukraine. The sanction of the article provides for a sentence of 5 to 8 years of imprisonment with confiscation of property.

The pre-trial investigation is being conducted by the Main Investigation Department of the State Bureau of Investigation with the operational support of the Territorial Department of the State Bureau of Investigation in Kramatorsk.

Motions will be submitted to the High Council of Justice to suspend judges from their positions and to request consent for their arrest.

Note: In accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime until their guilt is proven in a legal manner and established by a guilty verdict of the court.
