In the Khmelnytskyi region, a doctor will be tried, due to whose negligence the patient died

Prosecutors of the District Prosecutor's Office of the city of Khmelnytskyi have sent an indictment to the court against a neurosurgeon for the improper performance of his professional duties due to negligence, which caused serious consequences for the patient (Part 1 of Article 140 of the Criminal Code of Ukraine).
The investigation established that in April 2023, at one of the medical facilities in Khmelnytskyi, the doctor operated on a patient. After the surgery, the woman repeatedly complained about her condition.
After repeated complaints, the doctor performed a procedure that only masked the symptoms of the inflammatory process in the area of the postoperative wound. Soon after, the woman died. The connection between the neurosurgeon's actions and the patient's death was confirmed by the conclusions of two commission forensic medical examinations, including a repeated one.
The sanction for the charged article provides for punishment in the form of deprivation of the right to hold certain positions or engage in certain activities for up to five years, or corrective labor for up to two years, or restriction of freedom for up to two years, or imprisonment for the same period.
Note: according to Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
