The Prosecutor General's Office defended the Carpathian National Nature Park's right to more than 4,000 hectares of protected land

The Specialized Environmental Prosecutor's Office has entered into the consideration of the case regarding the cancellation of the state act on the right of permanent land use of the Carpathian National Nature Park. The Zelenska Village Council unjustifiably initiated this dispute in court, pursuing the goal of illegal acquisition of a land plot of over 4.3 thousand hectares, which belonged to the nature reserve fund. 

To prevent the loss of particularly valuable nature conservation areas from state ownership, the prosecutor's offices entered into the consideration of this case even at the stage of its review by the court of first instance.

 Currently, there is already a decision from the Supreme Court, which agreed with the prosecutors' arguments that the claims of the plaintiff are not based on law, as the contested state act does not violate his rights or interests, and the lands of the nature reserve fund cannot be transferred to private or communal ownership. 

The court of cassation upheld the decisions of the previous courts to deny the village council's claim to cancel the state act on the land.

Thus, the prosecutor's office confirmed in court the legality of the Carpathian National Nature Park's right to permanent use of its lands. 

As the prosecutors noted, this case is exemplary. One of the main reasons for encroachments on the lands of reserves and national parks remains the lack of established boundaries in nature (on the ground) and the absence of proper reflection of these boundaries in the State Land Cadastre.

 This creates real risks of illegal removal of lands from national parks, reserves, and sanctuaries from state ownership, leading to the destruction of unique ecosystems, reduction of forest areas, and loss of biodiversity. 

According to the State Enterprise "Center for State Land Cadastre," in the last year and a half, nearly 26 thousand land plots have been formed and registered in Ukraine, which completely or partially overlap with the boundaries of the nature reserve fund.

The prosecutor's offices have already begun a systematic study of the facts of land plots overlapping with the territories of the nature reserve fund. The Specialized Environmental Prosecutor's Office emphasized that each such case will be legally assessed and appropriate response measures will be taken, from initiating criminal proceedings to filing lawsuits aimed at returning illegally alienated lands to state ownership.
