The Office of the Prosecutor General has directed an indictment against the Expouse of the Ministry of Defense, which wrote off the entrepreneur 94 million UAH of penalties for overdue contracts

The indictment has been sent to the High Anti-Corruption Court for substantive consideration. The actions of the accused have been qualified under part 2 of Article 364 of the Criminal Code of Ukraine.
During the pre-trial investigation, it was established that in 2023, the Ministry of Defense entered into a number of contracts for the supply of military clothing with companies controlled by a businessman from Lviv.
The companies signed 23 agreements worth over 1.5 billion UAH.
At the time of the conclusion of the contracts, the companies had neither their own production capabilities nor agreements with other companies to ensure the proper execution of the agreements.
To avoid the imposition of penalties or to significantly reduce them, the entrepreneurs sought assistance from the acting director of the relevant Department of the Ministry of Defense of Ukraine. They requested a recalculation of the penalties imposed for failing to meet the delivery deadlines for the goods.
In violation of the norms of the previously concluded contracts, the accused unjustifiably and without grounds entered into additional agreements that extended the delivery deadlines for the goods, including for contracts that had already been fully executed. As a result, the imposed penalties were unjustifiably reduced from nearly 98 million UAH to 4.5 million UAH, that is, by 93.5 million UAH.
For this, he faces a punishment of up to six years of imprisonment.
The pre-trial investigation was conducted by the investigators of the State Bureau of Investigation under the procedural guidance of the prosecutor's office.
Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
