More than 30 hectares of forest will return to the owner. Prosecutors defended the right of the state to forest land in the Supreme Court
31.07.2025
Prosecutors from the Office of the Attorney General and the Poltava Regional Prosecutor's Office defended in the Supreme Court the state's right to forest fund land plots with a total area of over 30 hectares.
Prosecutors in courts of all instances proved that in 2020, decisions made by the sessions of the Bilohorilsk Village Council unlawfully changed the intended use of forest fund lands to agricultural lands and created all conditions for their unhindered transfer to private individuals. After obtaining ownership rights, citizens sold the land plots to a company from Sumy. In fact, the forest, which is under the permanent use of the State Enterprise "Forests of Ukraine," became the property of a private business entity that began extracting sand in these areas.
In order to prevent the destruction of the forest, prosecutors filed a lawsuit to declare the decisions of the village council invalid and to return the forest to its lawful owner - the state. The Economic Court of Poltava Region fully satisfied the claim of the Poltava Regional Prosecutor's Office. The Eastern Economic Court of Appeal and the Cassation Economic Court as part of the Supreme Court also supported the prosecutors' position.
Currently, measures are being taken to ensure the actual enforcement of the court decision.
