Reported suspicion to the head of the KSCA apparatus and the exclusive of the utility company

The Kyiv City Prosecutor's Office has notified the head of the executive body apparatus of the Kyiv City Council (Kyiv City State Administration) and the former head of the municipal company "ATP KMDA" of suspicion.
Their actions are qualified under part 5 of Art. 191 of the Criminal Code of Ukraine, namely as embezzlement of property by abuse of one's official position by an official, committed by a group of persons, in particularly large amounts, by prior conspiracy.
It was established that the suspects ordered and paid for the arrangement of the facade and other repair works in the office building on Borys Grinchenko Street in Kyiv, which had already been removed from communal ownership and belonged to private individuals.
Thus, the suspects paid for repairs amounting to almost UAH 1.3 million for a private building, as the municipal company does not even lease these premises.
Petitions have been prepared for the selection of preventive measures for the suspects in the form of detention with the alternative of bail in the amount of the damages caused.
The sanction of the article provides for punishment in the form of imprisonment for a term of up to twelve years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years and with confiscation of property.
The pre-trial investigation under the operational support of the SBI is carried out by the investigators of the Territorial Department of the SBI, located in the city of Kyiv.
According to Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
