Reported suspicion to the four servicemen of the National Guard who refused to execute the commanders of commanders

According to the investigation, servicemen from one of the units of the National Guard of Ukraine, stationed in the Kyiv region, at different times during martial law refused to carry out combat orders from their commanders regarding marching to a designated settlement in the area of combat operations.

Despite being fit for service and understanding their duty to strictly fulfill their constitutional obligations, the suspects openly refused to comply with the orders, thereby grossly violating military discipline and the requirements of current legislation.

The Darnytsia Specialized Prosecutor's Office in the field of defense of the Central region, together with the Territorial Office of the State Bureau of Investigations located in Kyiv, has notified four servicemen of suspicion of committing a criminal offense under Part 4 of Article 402 of the Criminal Code of Ukraine (disobedience committed under martial law). All four individuals have been placed in custody as a preventive measure.

The sanction of the incriminated article provides for punishment in the form of imprisonment for a term of five to ten years.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
