The prosecutor's office proved the guilt of the participants of the resonant road accident in Khmelnytskyi: a foreigner and a local resident were sentenced to the death of an 11-year-old child

This tragedy shook not only Khmelnytskyi, but also the whole of Ukraine. In 2019, an 11-year-old girl died, whose life was cut short by a traffic accident caused by gross traffic violations by both drivers.
From the first day, the Prosecutor's Office took the case under control. Prosecutors provided a full and objective study of the circumstances, took measures for the international search and extradition of one of the participants in the road accident, carried out procedural supervision, maintained public prosecution in court, which made it possible to prove the guilt of both participants in the fatal accident.
According to the investigation, the driver of the motorcycle, a local resident, was driving in the regional center with a speed exceeding more than twice, and the driver of the passenger car, performing a left-turn maneuver, did not give him an advantage in movement. As a result of the collision, the motorcycle was thrown at the girl who was standing on the sidewalk and waiting for the "green" light. The child received injuries incompatible with life, from which she died in the hospital on the same day.
After the accident, one of its participants, a citizen of a foreign country, left the territory of Ukraine. In agreement with the prosecutor, he was declared an international wanted man. In November 2021, the man was detained, after which, with the assistance of the Prosecutor's Office, he was extradited to Ukraine to face criminal charges.
Another driver was arrested immediately after the incident. In 2021, he was sentenced to 6 years in prison, with disqualification from driving for three years. The Supreme Court overturned the previous sentence for joint trial and after the second accused was extradited, the case was consolidated.
During the retrial, both defendants pleaded guilty. A citizen of a foreign country voluntarily compensated the child's parents for moral damage.
Based on the evidence provided by the prosecutor, examined in the court session, as well as taking into account the behavior of the defendants and the position of the victims, who insisted on differentiated punishment considering the motorcyclist more guilty in the accident than the foreigner, the court on 04.08.2025 found both guilty under Part 2 of Article 286 of the Criminal Code of Ukraine (violation of traffic safety rules resulting in the death of the victim).
The foreign citizen, the driver of the car, was sentenced to 3 years and 9 months of imprisonment with disqualification from driving for 3 years. The court, taking into account the admission of guilt by the citizen of the Republic of Turkey, the compensation for moral damage to the child's parents in the amount of one million hryvnias, age of 75 years, health condition, and the position of the victims, released him from custody in the courtroom due to the full serving of his sentence in the detention center.
The local resident, the motorcycle driver, received 5 years and 8 months of imprisonment with the same additional restriction. This measure of punishment was determined in connection with the admission of guilt, positive characterization, and the presence of two dependent children. By the court's decision, the motorcyclist will pay the victims 500,000 UAH in moral damages.
Until the verdict comes into force, the motorcycle driver will be in custody.
Crimes committed against children, as well as cases of deaths of minors, which have gained wide publicity, are under special control of the Prosecutor's Office.
The Prosecutor's Office will continue to ensure the effective investigation of such crimes, the inevitability of punishment, and the protection of the rights of victims, primarily – children.
