The prosecutor's office defended a 10 -year detention of a minor rapist from Khmelnytsky

A resident of the Khmelnytskyi district will serve a sentence of 10 years in prison for the rape of a minor and illegal entry into a dwelling (part 3 of Article 152, part 1 of Article 162 of the Criminal Code of Ukraine).

The appellate court, based on the principled position of the juvenile prosecutors of the Khmelnytskyi regional prosecutor's office, left the appeal of the defense side unsatisfied and the court's verdict unchanged. The court decision has now entered into legal force.

According to the case materials, on the day of his release from places of deprivation of liberty, the convicted man went to visit his acquaintances. There was no one at home – he entered the house through the window, which the owners were renting to a 17-year-old student.

Prosecutors proved that when the girl returned home, the man held a kitchen knife to her neck and raped her. Afterward, he tied her hands, ordered her not to move, and to remain silent.

The victim was able to be rescued thanks to her sister, who became concerned that she had not gone to work.

The man awaited the court's verdict in custody.

The punishment assigned by the first-instance court was appealed by the defense. At the same time, the appellate court rejected all arguments regarding the lack of evidence of guilt and the severity of the imposed punishment.
