The prosecutor's office defended from the construction of a land plot in Holosiivskyi district of Kiev, which houses the water tower - the object of cultural heritage

The Kyiv City Prosecutor's Office has entered into a legal dispute between the Kyiv City Council and the developer, who has compelled the Kyiv Council through the court to renew the lease agreement for a land plot located in the Holosiivskyi district of the capital.

This plot was leased to the company in 2004 for the construction of a residential complex. However, for almost 20 years, the company has not fulfilled its obligations, and construction has not commenced.

In 2023, a valuable example of 20th-century architecture—a water tower—was discovered on this territory. By order of the Department of Cultural Heritage Protection dated 13.02.2023, it was recognized as a cultural heritage site.

At the same time, the Economic Court of Kyiv and the Northern Appeal Economic Court supported the developer and satisfied his claim, thereby allowing construction on the land plot where the tower is located.

Upon the cassation appeal of the Kyiv City Prosecutor's Office, the Supreme Court annulled the illegal decisions of the lower courts and denied the developer's claims.

The court of cassation agreed with the prosecutor's arguments regarding the necessity to preserve valuable elements of the historical environment for the capital, of which the water tower is a part.
