Prosecutors of Lviv region defended the right of the community to the Nikolaev fortress

Thanks to the Lviv Regional Prosecutor's Office, it was possible to prevent the illegal removal from communal ownership of a local historical monument - the Complex of Fortifications and Engineering Structures "Fortress of Mykolaiv".

The Mykolaiv fortress is a unique military historical monument and fortification construction from the second half of the 19th to the early 20th century in Ukraine. It has preserved its authentic planning and spatial structure, holds historical and scientific-technical value, and is also a tourist attraction.

The prosecutor discovered that the area where the remains of temporary fortification structures are located occupies a significant area and borders, and in some places intersects, with sand quarries on the outskirts of Mykolaiv. Moreover, within the historical complex, over 24 hectares of land are privately owned, where the landowners plan to extract sand.

To protect the monument, the Mykolaiv City Council adopted a decision in 2021, according to which the fortification structures are transferred to the ownership of the city. Additionally, to preserve the monument, maps of the fortress's parts were posted on the official website of the city council, and landowners were further informed about the existing restrictions on the use of these lands.

However, the landowners, aiming to extract sand from these lands, were unwilling to comply with the requirements of heritage protection legislation. Consequently, they challenged the decision of the Mykolaiv City Council and annulled it in court.

Defending cultural values and disagreeing with the decision of the first instance court, the regional prosecutor's office appealed to the appellate court.

Agreeing with the arguments of the prosecutors, the court upheld the decision of the Mykolaiv City Council regarding the acceptance of the disputed plots into communal ownership.
