Fraudulent seizure of forest lands in Chernivtsi region

Prosecutors of the Specialized Environmental Prosecutor's Office of the Office of the Prosecutor General have notified the wife of the head of the Myhiv Village Council in the Chernivtsi region and three individuals close to her of suspicion in the fraudulent acquisition of land plots in the forest located within the Myhiv Forestry and their legalization through sale (Part 4 of Article 190 (valid until 11.08.2023), Part 3 of Article 28, Part 4 of Article 358, Part 3 of Article 209 of the Criminal Code of Ukraine).

The investigation established that at the beginning of 2022, the head's wife, wishing to acquire land plots from the forest fund located at the top of the mountain near the ski resort "Myhovo," created an organized group that included close individuals.

Implementing a joint criminal plan, acting with selfish motives, the members of the organized group used forged state acts of ownership rights to land to produce land-technical documentation, assign cadastral numbers, and carry out state registration of ownership rights to the formed land plots.

During the investigation, it was found that based on the forged state acts of ownership rights to land plots located within the Myhiv Forestry of the Berehomet Forestry Branch of the "Podilskyi Forestry Office" of the State Enterprise "Forests of Ukraine," with an area of 6 hectares and a value of 3,456,748 UAH, the state registrar registered ownership rights for individuals who were part of the organized group.

After formalizing ownership rights to the land plots based on forged documents, with the aim of further selling them to a pre-selected buyer, the participants in the criminal scheme intentionally subdivided the illegally obtained lands into smaller areas and sold them at undervalued prices.

Currently, the issue of choosing a preventive measure in the form of detention is being resolved, and measures are being taken to arrest the property.

The pre-trial investigation is being conducted by the Main Investigative Department of the State Bureau of Investigations with operational support from the 1st Department of the "D" GU of the Security Service of Ukraine.

At the same time, the Specialized Environmental Prosecutor's Office has filed 3 lawsuits in court to reclaim forest management lands located in the village of Myhovo from the illegal possession of individuals.

Currently, decisions of the Vyzhnytsia District Court of the Chernivtsi region have fully satisfied two lawsuits from the Deputy Prosecutor General, and the court decisions have been effectively executed, returning land plots with a total area of 4 hectares to state ownership.

Another lawsuit from the prosecutor is under consideration.

Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
