At the request of the head of the Specialized Prosecutor's Office in the field of defense of the Southern region, the court opened proceedings in the case of recovering funds in favor of the state from one of the private enterprises.

This concerns unjustly received monetary funds, in particular, value-added tax, as well as the accrual of 3% annual interest and inflation losses. The lawsuit was filed in the interests of the Ministry of Defense of Ukraine.

It has been established that a contract was concluded between the Ministry of Defense of Ukraine (represented by the Southern Capital Construction Management) and a Limited Liability Company for the construction of a 10-story building in Odesa. The facility was intended to provide housing for servicemen of the Armed Forces of Ukraine. The cost of the work under the contract amounted to over 55 million hryvnias.

According to the legislation, such projects funded by the state budget are exempt from taxation. However, contrary to these norms, over 12 million hryvnias was unjustly transferred to the account of the private enterprise as value-added tax.

The prosecutor's office, having identified violations of the economic interests of the state, promptly appealed to the court with a demand to return the specified funds to the budget, along with the accrual of 8.7 million hryvnias in inflation losses and 1.7 million hryvnias (3% annual interest) for the overdue amount.

The court proceedings are ongoing. The prosecutor's office will take all necessary measures to restore the violated rights of the state and return the budgetary funds.
