According to the case materials, in 2009, the Kyiv-Sviatoshyn District State Administration of Kyiv Oblast illegally seized part of the territory of the military town with an area of 4.745 hectares without the consent of the permanent land user – the National University of Defense of Ukraine named after Ivan Cherniakhovskyi, with nearly 1 hectare being transferred into private ownership.

Despite the court ruling, which in 2013 recognized the relevant order of the district state administration as illegal and annulled it, as well as declared the state act on the right of ownership of the specified land plot invalid, it was resold to other individuals.

In light of this, in October 2016, the specialized prosecutor's office appealed to the court with a new lawsuit for the recovery of the plot from illegal possession.

In 2019, by a ruling of the Supreme Court, the land plot was recovered in favor of the state represented by the National University of Defense of Ukraine named after Ivan Cherniakhovskyi, and it was established that the University is the legal and competent user of the land plot.

However, even after this, it turned out that the plot was again resold to another owner, who acquired it despite the existing court decision—this time under a purchase and sale agreement.

In order to restore the violated rights of the state, the Specialized Prosecutor's Office in the sphere of defense of the Central region has filed a lawsuit again for the recovery of the land plot from illegal possession.

As a result of a lengthy court hearing, in July 2025, the Kyiv-Sviatoshyn District Court of Kyiv Oblast granted the prosecutor's claims. The disputed land plot, valued at over 1.8 million UAH according to the normative assessment, has been returned to state ownership.
