On July 31, 2025, the Economic Court of Kyiv fully satisfied the claim of the Deputy Head of the Specialized Prosecutor's Office in the Defense Sector of the Central Region for the recovery of unjustly obtained funds in favor of the state from one of the private enterprises.

It was established that a number of contracts for the supply of fuel and lubricants for defense needs were concluded between the Ministry of Defense of Ukraine and a limited liability company for a total amount exceeding 27 million UAH.

According to the legislation, goods for refueling and re-fueling ground vehicles under the legal regime of martial law are subject to value-added tax at a rate of 0%. However, contrary to these norms, over 5.6 million UAH of VAT was unjustly transferred to the account of the private enterprise.

The Specialized Prosecutor's Office in the Defense Sector of the Central Region, having identified violations of the economic interests of the state, promptly appealed to the court with a demand to return the specified funds to the budget, with the calculation of inflation losses and 3% annual interest on the overdue amount.

As a result of the court proceedings, thanks to the principled position of the Specialized Prosecutor's Office in the Defense Sector of the Central Region, the claim was fully satisfied, and the specified amount is subject to recovery from the company in favor of the state represented by the Ministry of Defense of Ukraine.
