Prosecutors of the Office of the Attorney General have completed the pre-trial investigation and sent an indictment to the court regarding a Russian soldier who, during the occupation of Zaporizhzhia region, unlawfully detained a civilian woman and raped her for three days.
The accused is the commander of the 4th company of the 2nd motorized rifle battalion of the 4th Guards military base (military unit 66431) of the 58th Combined Arms Army of the Southern Military District of the Armed Forces of the Russian Federation.
The investigation established that from November 29 to December 1, 2022, after the occupation of the settlement, the soldier, using the actual power of an armed person and the atmosphere of fear among the civilian population, unlawfully deprived a local resident of her liberty.
The woman was held in a private house without the ability to leave the premises or seek help. For three days, she was in complete isolation and dependent on the soldier.
Taking advantage of the victim's defenseless position and the absence of any protection during the occupation, the accused raped her.
His actions are classified under Part 1 of Article 438 of the Criminal Code of Ukraine. The sanction of this article provides for imprisonment for a term of 8 to 12 years.
Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
