Prosecutors of the Holosiivskyi District Prosecutor's Office in Kyiv have reported suspicion against a 44-year-old director of a private company that unlawfully seized land on Zhukov Island and began construction there with the aim of subsequently obtaining the land for use on legal grounds.
The investigation has established that several private companies were involved in the scheme, and ownership rights to real estate on the island were registered, which actually does not exist.
Thus, the first company, which was engaged in sand dredging, requested the Kyiv City Council in 2014 to allocate them a plot of land for servicing a small building, but they were denied.
Subsequently, to increase their chances of land allocation, this company registered ownership rights to non-existent buildings (sand warehouses). After that, the "real estate" was sold to the suspect's firm, which later changed its name. This firm began unlawfully constructing real estate on the island that already existed "on paper."
These unfinished constructions were sold to another company, which, as the owner of the buildings, now has the right to appeal to the Kyiv City Council for land allocation on legal grounds – as the owner of the real estate.
It should be noted that the land plot on Zhukov Island, which they wanted to seize unlawfully by starting construction there, has an area of 11 hectares and an estimated value of over 40 million hryvnias. Thanks to the timely response of law enforcement, the scheme to seize the land was not realized.
Currently, the head of the company that initiated the illegal construction on the island has been notified of suspicion under part 5 of Article 27, part 5 of Article 190, part 4 of Article 358, and part 4 of Article 197-1 of the Criminal Code of Ukraine, specifically for facilitating the acquisition of the right to obtain land for the maintenance of residential buildings or structures through deception and forgery of official documents.
The investigation is ongoing, and other participants involved in the crime are being identified.
The pre-trial investigation is being conducted by investigators of the Holosiivskyi District Police Department of the National Police in Kyiv with operational support from the Main Investigation Department of the National Police of Ukraine in Kyiv.
Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
