Avoiding the mobilization of conscripts: the prosecutor's office exposed illegal mechanisms in two regions of Ukraine

The prosecutor's office, together with law enforcement agencies, continues to uncover and document facts of organizing mechanisms that helped conscripts avoid mobilization. Thus, in Prykarpattia, offenders organized the smuggling of individuals through the mountain range, while in Lviv region, they provided fictitious deferments.
Prykarpattia
Two residents of Chernivtsi region organized the smuggling of three conscripts through the mountain range of the Verkhovyna district for a monetary reward. They coordinated the actions of the men and accompanied them along the route.
The illegal activities were stopped by the employees of the State Border Guard Service of Ukraine.
Prosecutors of the Kosiv District Prosecutor's Office informed them of suspicion under Part 2, Part 3 of Article 332 of the Criminal Code of Ukraine — illegal smuggling of persons across the state border of Ukraine and aiding in this, committed by prior conspiracy for mercenary motives.
The pre-trial investigation in the criminal proceedings is being conducted by investigators of the Verkhovyna District Police Department of the Main Directorate of the National Police in the region.
Lviv Region
Three residents of Lviv region were issuing deferments from mobilization to conscripts, profiting from this. One man was finding "clients," another was passing the men's documents to a participant in the scheme, who worked at the Shevchenkivskyi District Military Registration and Enlistment Office and promised to influence the commission's decision regarding the issuance of documents.
Deferments were issued to two men for one thousand and one and a half thousand dollars per person.
Law enforcement conducted 12 searches, during which military registration and medical documents of conscripts, phones, and rough notes were seized.
Prosecutors of the Lviv Regional Prosecutor's Office informed them of suspicion of abuse of influence (Part 2 of Article 28, Part 3 of Article 369-2 of the Criminal Code of Ukraine).
In a similar criminal proceeding, the case has already been sent to court. It concerns three individuals who organized the illegal smuggling of a conscript abroad for 11 thousand US dollars. It is worth noting that they were uncovered and informed of suspicion in May and September 2025. It has been established that the man from Lviv was transported to the smuggling location in Romania through several regions, changing cars five times. One of the "smugglers" was detained after receiving the money, while the other two — the organizer and the accomplice — were located and arrested a few months later.
All three are charged with illegal smuggling of persons across the state border (Part 3 of Article 332 of the Criminal Code of Ukraine).
Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
