Evasion of mobilization and illegal crossing of persons through the state border: Among the 34 suspects of lawyer and expert inter -district MSEC

The Prosecutor General’s Office continues to systematically counter evasion of mobilization and the illegal transfer of persons across the State border. Today, August 20, prosecutors along with investigators of the National Police of Ukraine, with the operational support of the Security Service of Ukraine, notified 34 persons of suspicion. 

Among the suspects is a lawyer from Zaporozhzhia who demanded and received USD 5,500 from a conscript for assistance in deferring mobilization on the basis of an act establishing permanent care for the mother. 

She also had to organize a military medical commission without the actual presence of the man. For “resolving” these issues, the suspect planned to influence officials of state and local authorities. Her actions are qualified as abuse of influence (part 3 of Art. 369-2 of the Criminal Code of Ukraine). Prosecutors are preparing a motion to choose a preventive measure for her.

In Poltava Oblast, an organized group led by the head of the interdistrict Medical and Social Expert Commission (MSEC) was exposed, which organized a criminal scheme to establish and continue disability groups for citizens. The participants of the scheme forged a package of medical documents and issued fictitious referrals to the MSEC. On their basis, the organizer of the scheme issued a certificate on the presence of disability. The cost of the service ranged from UAH 10,000 to USD 2,000. The organizer was notified of suspicion for receiving an illegal benefit as part of an organized group (part 3 of Article 28 part 3 of Article 368 of the Criminal Code of Ukraine). The suspects also include 10 “clients,” 2 members of an organized group, and 6 accomplices. 

Depending on the participation and role of everyone in illegal activities, their actions are qualified as: 

- providing an unlawful benefit to an official (part 3 of Art. 369 of the Criminal Code of Ukraine);

- obtaining an unlawful benefit as part of an organized group (part 3 of Article 28, part 3 of Article 368 of the Criminal Code of Ukraine) 

- aiding and abetting in obtaining an unlawful benefit by the organizer (part 5 of Article 27, part 3 of Article 368 of the Criminal Code of Ukraine).

In total, 19 persons were notified of suspicion. The facts of the transfer of an illegal benefit for establishing a disability group to 43 persons had been documented. The Prosecutor's Office initiated reviews of the specified groups of disability for the specified persons. So far, 17 decisions have been canceled.

Also, prosecutors along with investigators and operatives of the National Police of Ukraine notified of suspicion 11 conscripts for evading conscription - Art. 336 of the Criminal Code of Ukraine. Two servicemen – in evasion of military service and fraud (part 4 of Art. 409, part 1 of Art. 190 of the Criminal Code of Ukraine). The latter provided the command of the military unit with forged documents that give grounds for dismissal from military service.

In addition, in the Chernivtsi region, the activities of a group of individuals who created fictitious transport companies and illegally transported 96 men across the border under the guise of international and humanitarian transport drivers were terminated. Three individuals were reported for suspicion under part 3 of Art. 332 of the Criminal Code of Ukraine. 

Pre-trial investigations under the procedural supervision of the Prosecutor General’s Office are carried out by investigators of the National Police of Ukraine under the operational support of the Department of Strategic Investigations of the National Police of Ukraine and Security Service of Ukraine.
