Elble on payment of rent for the use of subsoil for over UAH 27 million: the court will stand the director

Under the procedural guidance of the Specialized Environmental Prosecutor's Office of the Prosecutor General's Office, the pre-trial investigation has been completed, and an indictment has been sent to court against the director of the enterprise who organized a scheme to evade payment of rent for the use of subsoil amounting to over 27 million UAH.

He is accused of intentional tax evasion, which resulted in a significant shortfall in budget revenues (part 3 of Article 212 of the Criminal Code of Ukraine).

The investigation established that from 2020 to 2024, having a special permit for subsoil use, the enterprise extracted granite in the Vinnytsia region.

According to the decision of the State Commission of Ukraine on Mineral Resources, it was supposed to produce commercial products - rubble stone and crushed stone - from the extracted raw materials and pay rent based on their sale value.

The director of the enterprise organized the sale of the extracted products to a related entity at artificially low prices - from 40 to 90 UAH per ton. A total of about 7.5 million m³ of granite products were sold. Subsequently, this enterprise resold the goods at market prices to construction companies.

As a result of this scheme, over 27 million UAH in rent payments did not reach the state budget.

The pre-trial investigation was conducted by detectives of the Bureau of Economic Security of Ukraine.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
