The Grand Chamber of the Supreme Court supported the position of the prosecutor's office

The Grand Chamber of the Supreme Court upheld the position of the Office of the Prosecutor General in the case regarding the illegal registration of land in the border zone as communal property.

Prosecutors proved that the plots located within the 30-50 meter zone along the state border of Ukraine cannot be in communal ownership and used for agricultural purposes. Their intended use is for the establishment and maintenance of engineering and technical structures necessary for the protection of the state border.

The village council, contrary to the requirements of the legislation, registered the right of communal ownership over such lands. The first-instance court denied the prosecutor's claim; however, the Grand Chamber of the Supreme Court disagreed with this decision.

The court recognized that the location of the plot within the border zone inherently determines a special legal regime for its use. Therefore, the previous court decisions were annulled, and the case was sent for a new hearing taking into account the conclusions of the Grand Chamber of the Supreme Court.

This decision solidifies an important legal position regarding the protection of state interests in border regions and creates a precedent for other similar cases.
