The scheme of illegal acquisition of electricity for more than 168 million hryvnias was exposed

Under the procedural guidance of prosecutors from the Office of the Attorney General, three participants in a scheme to unlawfully acquire electricity without actual payment have been notified of suspicion. According to the investigation, as a result of these actions, JSC "NEC "Ukrenergo" suffered damages amounting to 168 million UAH.

The director of a commercial enterprise and the former director of the electricity supplier are accused of embezzling funds from JSC "NEC "Ukrenergo" (part 5 of Article 191 of the Criminal Code of Ukraine).

A responsible official of JSC "NEC "Ukrenergo" is accused of abusing their official position to obtain unlawful benefits for another legal entity (part 2 of Article 364 of the Criminal Code of Ukraine). According to the investigation, the official intentionally failed to apply the legislative measures of response to the electricity supplier.

The investigation has established that officials of the industrial enterprise initiated the conclusion of a contract for the supply of electricity with a controlled supplier, while having no actual intention to pay for the consumed volumes.

At the same time, the electricity supplier, according to the investigation, did not purchase electricity in the established manner, but received it due to imbalances formed by the transmission system operator. Mandatory payments for imbalances were not made.

An official of JSC "NEC "Ukrenergo", holding a managerial position and having the authority to administer calculations in the electricity market, intentionally failed to take the legislative measures of response.

As a result, according to the investigation, over 82 thousand MWh of electricity was unlawfully released, with a total value exceeding 168 million UAH, causing material damage to JSC "NEC "Ukrenergo" and leading to severe consequences.

During searches at the residences of the suspects, rough notes and documents of evidential significance were seized.

The pre-trial investigation is being conducted by the Main Investigative Department of the National Police of Ukraine with operational support from the Department of Strategic Investigations of the National Police.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
