Prosecutors of the Specialized Environmental Prosecutor's Office returned a plot of land in the "Voronovytska Dacha" area within the Shenderivskyi Forestry in Vinnytsia region, the majority of which is occupied by a pond.

The prosecutors established that the enterprise received it for use allegedly as a forest area. At the same time, over 75% of the area consisted of a water body, which can only be leased based on the results of land auctions in accordance with the requirements of water and land legislation.

Since the transfer of the water body under the guise of forest was contrary to the law, the prosecutor's office appealed to the court demanding to declare the contract invalid and return both the pond and the adjacent forest area to the state. The claims were satisfied by the appellate court.

The Supreme Court, having considered the cassation appeal of the defendant, agreed with the prosecutor's arguments and left the decision of the appellate court unchanged. Thus, both the water body and the forest area were returned to state ownership.
