The Economic Court of Rivne Region supported the claim of the environmental prosecutor and ordered the tenant to pay over 1.3 million UAH in debt for land rent in favor of the Vyryv community.

Thus, prosecutors established that in 2019, a lease agreement for a land plot for the placement of buildings and structures related to the use of subsoil for the development of a deposit was concluded between a private company and the Rivne Regional State Administration in the territory of one of the settlements in the Sarny district.

The parties agreed on the lease terms and the amount of rent, which was determined based on the normative monetary valuation of the land plot, with an area of about 30 hectares.

However, the private company did not pay the rent during 2023-2025, resulting in a debt of over 1.3 million UAH.

Legislation stipulates that systematic non-payment of funds for the use of land plots is grounds for terminating lease agreements, which is why the prosecutor's office turned to the court.

After the decision comes into legal force, prosecutors will take measures to enforce it. 

This case once again confirms the importance of the systematic work of the prosecutor's office in identifying violations in the field of environmental protection and defending the interests of territorial communities.
