Prosecutors of the Podil District Prosecutor's Office have reported suspicion against the director of the company that supplied electricity to KP "Kyivpastrans" at inflated prices.

The actions of the suspect are qualified under part 5 of Article 191 of the Criminal Code of Ukraine, namely the appropriation of funds from KP "Kyivpastrans" by issuing invoices to the municipal enterprise for payment without taking into account the reduction in electricity prices.

It has been established that the private company and the municipal enterprise entered into a contract for the supply of electrical energy. Subsequently, the director of the company did not inform KP "Kyivpastrans" about the decrease in the cost of electricity, although he was obliged to do so according to the concluded contract and legislation.

According to the conclusions of the conducted examinations, KP "Kyivpastrans" overpaid under this contract by almost 11.5 million hryvnias, causing losses to the capital's budget in that amount.

It should be noted that earlier suspicion was reported for official negligence against the former head of one of the departments of KP "Kyivpastrans" (part 2 of Article 367 of the Criminal Code of Ukraine), who was supposed to monitor the decrease in electricity prices.

The pre-trial investigation is being conducted by investigators of the Podil District Police Department of the Main Directorate of the National Police in Kyiv with operational support from the Main Directorate of the Security Service of Ukraine.

The sanction of the article provides for imprisonment for a term of seven to twelve years, with deprivation of the right to hold certain positions or engage in certain activities for up to three years and with confiscation of property.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
