The prosecutors of the Khmelnytskyi Regional Prosecutor's Office have sent an indictment to the court regarding former officials of the city council, the director of the contracting company, and the technical supervision engineer.

The actions of the city council officials and the head of the contracting organization have been qualified as embezzlement of someone else's property, committed by abuse of office, in particularly large amounts (part 5 of Article 191 of the Criminal Code of Ukraine), as well as official forgery (part 1 of Article 366 of the Criminal Code of Ukraine).

The technical supervision engineer is charged with official forgery (part 1 of Article 366 of the Criminal Code of Ukraine).

The investigation established that in 2019-2020, they embezzled 4.5 million UAH of budget funds allocated under the presidential program "Great Construction" for the capital repair of the city stadium named after H.A. Tonkocheyev in Kamianets-Podilskyi.

Abusing their official positions, the heads of the structural divisions of the city council and the contractor included false information in the acts of completed works. They indicated parts of the drainage and covering works that had not been performed.

To implement this illegal scheme, they also involved the technical supervision engineer, who approved the specified acts.

In this way, on works worth over 11 million UAH, about 40% of the allocated budget funds ended up in the hands of the accomplices.

The pre-trial investigation was conducted by investigators of the Main Directorate of the National Police in the Khmelnytskyi region with operational support from the Department of Strategic Investigations of the National Police.

The sanction of part 5 of Article 191 of the Criminal Code of Ukraine provides for up to 12 years of imprisonment with deprivation of the right to hold certain positions or engage in certain activities for up to three years and with confiscation of property.

Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
