They took possession of another's property, including foreign investors, by over UAH 3.8 million - prosecutors exposed the Ternopil spouses

The director of the company and his wife have been informed of suspicion of misappropriating someone else's property by abusing their official position (part 5 of Article 191 of the Criminal Code of Ukraine). Additionally, the woman has been charged with using property obtained through criminal means (part 5 of Article 191, part 1 of Article 209 of the Criminal Code of Ukraine).
In 2019-2020, a resident of Ternopil created two limited liability companies together with citizens of the USA and appointed himself as the director. The main financial contributions to these companies were made by foreign investors. After building a residential building in the village of Velyka Berezovytsia near Ternopil, the director of the company embezzled over 750,000 UAH obtained from the sale of apartments belonging to the legal entity. The investors, however, did not receive any funds from the sale.
Subsequently, the suspect engaged in the production of toilet paper, purchasing non-residential premises with an area of 1324.9 square meters and a land plot of 0.4280 hectares in the village of Yarchivtsi, Ternopil district, using funds from another company, as well as the necessary equipment. However, his true intentions were to seize the property of the factory, with a total value of over 3.1 million UAH. To do this, he and his wife, under the guise of concluding a civil agreement, illegally re-registered the land and buildings to a newly created legal entity, and embezzled the funds obtained from the sale of the remaining property of the company.
The entrepreneur's wife entered into a mortgage agreement, using real estate obtained as a result of illegal actions as collateral when receiving a loan of 700,000 UAH. Thus, she took actions to legalize it.
Currently, the investigating judges have imposed a seizure on the property of the suspects, estimated at over 15 million UAH. The factory premises and equipment have also been seized and transferred to the management of ARMA to ensure their preservation.
The pre-trial investigation is being conducted by investigators of the Territorial Department of the State Bureau of Investigation located in Lviv, under the procedural guidance of the Ternopil Regional Prosecutor's Office.
Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
