Генеральний прокурор Ірина Венедіктова та прокурор Міжнародного кримінального суду Карім Хан оглянули місця воєнних злочинів РФ у Харкові. Вони обговорили спільні кроки стратегії притягнення до відповідальності та правосуддя.

“Прокурор Хан уважно обстежує всі місця злочинів, ставить важливі професійні питання нашим прокурорам. На фронті справедливості ми з ним пліч-о-пліч: в незалежному розслідуванні Офісу прокурора МКС українська прокуратура надає активне сприяння Гаазі. Водночас ми разом працюємо в рамках Спільної слідчої групи на платформі Євроюсту, до якої Офіс прокурора Міжнародного кримінального суду долучився в перше в своїй історії”, – підкреслила Ірина Венедіктова.  

Під час третього візиту прокурора МКС в Україну, він відвідав найбільш постраждалий район Харкова – Північну Салтівку, а також Шевченківський район, де 26 травня загинули 9 осіб та 17 були поранені. Територію району майже дві години безперервно обстрілювали ймовірно  із самохідних гармат «Піон». Серед вбитих - 5-місячний хлопчик, якого відкинуло на дашок під’їзду з батькових рук. 

“Місця, де лежали потерпілі, й досі марковані жовтими прапорцями, а тротуарна плитка збита осколками.  На “спальній” Північній Салтівці немає жодних військових об’єктів і при цьому майже кожен другий будинок - свідчення воєнного злочину. Історичні будівлі в центрі тепер – пам‘ятки доби російського варварства в 21 столітті”, – поділилася Генпрокурор.  

В результаті перманентних атак в Харкові та області загинули вже 760 цивільних, поранено більше 1000. Зруйновано більше 4000 об’єктів, з яких майже 2500  – багатоповерхівки. Прокурори в області під обстрілами збирають надважливі докази та свідчення для активізації розслідування воєнних злочинів. Вже є перші вироки російським військовим, які обстрілювали цивільні об‘єкти області з артилерії. 

“Завдяки змінам до законодавства у МКС є необхідні процесуальні інструменти для роботи «на землі». На черзі – відкриття їх представництва в Україні. Завдання нашої правоохоронної системи нині надати всі можливості нашим колегам працювати об‘єктивно, незалежно і швидко. Синергія національного і міжнародного правосуддя – наш ключ до справедливості”, – резюмувала Ірина Венедіктова. 

Prosecutor General Iryna Venediktova and Prosecutor of the International Criminal Court (the ICC) Karim Asad Ahmad Khan inspected the sites of Russian war crimes in Kharkiv. They discussed joint steps in the strategy of prosecution and justice.

“Prosecutor Khan has been carefully examining all crime scenesand engages with out prosecutors on important legal issues. We stand together on the forefront of justice: while the Office of the Prosecutor (the OTP) of the ICC has been undertaking independent investigation in situation of Ukraine, our office has been actively assisting the OTP in this direction. At the same time, we are closely collaborating with the OTP through Joint Investigation Team (JIT) created under the auspices of Eurojust. Notably, the Office of the Prosecutor of the ICC has joint the JITfirst time in its history,” Iryna Venediktova said.

During his third visit to Ukraine, the Prosecutor of the ICC hasvisited the most affected district in Kharkiv, Northern Saltivka, as well as Shevchenkivskyi district, where nine persons have beenkilled and 17 injured on 26 May 2022. This district has been shelled for almost two hours, allegedly from self-propelled artillery “Pion”. A 5-months-old infant has been among the victims. An infant has been thrown onto the porch of the building right from his father's arms.

“The places where the victims lay are still marked with yellow flags, while the paving slabs broken by the projectile fragmentscould be still observed. There are no military facilities in the residential community of North Saltivka, and almost every house is an evidence of a war crime. The leveled historic buildings are clear illustration of the Russian barbarism in the 21st century,” said the Prosecutor General.

Till now 760 civilians have been killed and more than 1,000 injured as a result of continues attacks in Kharkiv and its respective district. More than 4,000 facilities have been destroyedamong them 2,500 being high-rise buildings (residential blocks). The Prosecutors are in process of gathering critical evidence and testimonies to step up war crimes’ investigation. The first verdicthas already been handed down against the Russian military that have participated in shelling of civilian targets in the region.

“The ICC has all the necessary procedural instruments to work "on the ground" as a result of recent legislative amendments. The next step would be the opening of their representative office in Ukraine. As of today, the primary task of our law enforcement authorities is to provide all necessary opportunities to our colleagues to work objectively, independently, and promptly. The synergy amongnational and international stakeholders is key to delivery of justice,” Iryna Venediktova summed up.
