За процесуального керівництва прокурорів Житомирської обласної та окружних прокуратур повідомлено про підозру 28 особам з числа органів місцевого самоврядування, комунальних установ, підприємств та підрядних організацій. Серед підозрюваних:

- Колишній керівник Держземагентства у Кіровоградській області, директори КСП «Ксаверівське», КСП «Барвінківське» та ТОВ «Барвінківське», та ще 4 співучасника, які заволоділи 152 земельними ділянками Малинської та Чоповицької громад загальною площею 1747 га, вартістю 15,5 млн грн;

- Начальник управління Житомирської міської ради та директори КП «Житомирводоканал» і КП «Звягельводоканал», які завищили вартість закупівлі електроенергії на суму 6,9 млн грн;

- Начальник відділу Оліївської сільської ради, через дії якого незаконно передано у власність 3 земельні ділянки загальною площею 3,5 га, чим заподіяно шкоду на 5,3 млн грн;

- Депутат Житомирської міської ради, який не задекларував майно на 4,8 млн грн;

- Директори ліцею та ТОВ (підрядник), які під час капітального ремонту частини будівлі ліцею Овруцької громади привласнили 1 млн грн;

- Колишній директор філії АТ «Державна продовольчо-зернова корпорація України» Черняхівський елеватор», який заволодів зерном соняшнику на суму 913 тис. грн;

- Четверо службових осіб ДП «Комбінат «Рекорд», які фіктивно оформлювали працівників та заволоділи коштами підприємства в сумі 835 тис. грн;

- Начальник відділу Станишівської сільської ради, службова недбалість якого при розпорядженні землями лісового фонду призвела до збитків в розмірі понад 600 тис. грн;

- Директор ТОВ (підрядник), який заволодів 620 тис. грн бюджетних коштів при встановленні вікон у закладі дошкільної освіти та легалізував бюджетні кошти у сумі 400 тис. грн під час заміни вікон у професійному будівельному ліцеї;

- Директор КП «Звягельсервіс», який розтратив 366 тис. грн при виконанні ремонту міського кладовища;

- Голова Головківської сільської ради, яка внесла неправдиві відомості до договору оренди земельної ділянки площею 100 га, вартістю 436 тис. грн;

- Генеральний директор КНП «Коростенська міська лікарня», який привласнив 434 тис. грн державних коштів від НСЗУ як відшкодування за лікування пацієнтів після інсультів;

- Службова особа Малинської міської ради, яка вимагала та отримала 35 тис. грн за невтручання у законну діяльність ФОПа щодо видалення лісових насаджень.

- Двом директорам ТОВ (підрядник), який заволодів понад 400 тис. грн під час реконструкції дитячого садка в селищі Чоповичі.

У межах кримінальних проваджень встановлено збитків на понад 33 млн грн, майже 5 млн грн – вартість незадекларованого майна, 400 тис. грн – легалізованих бюджетних коштів.

Дії підозрюваних кваліфіковано за ч. 4 ст. 190, ч.ч. 2, 4, 5 ст. 191, ч. 1 ст. 209, ч.ч. 1, 2 ст. 364, ч. 1 ст. 366, ч. 2 ст. 366-2, ч.ч. 1, 2 ст. 367, ч. 3 ст. 368 КК України.

Прокурори готують клопотання про обрання запобіжних заходів та відсторонення підозрюваних від посад. Вживаються заходи для відшкодування завданих збитків.

Крім того, до суду скеровано обвинувальний акт стосовно трьох осіб – заступників директора приватного підприємства з м. Дніпра та виконувача обов’язків директора державного підприємства на Житомирщині. Їх затримали під час отримання неправомірної вигоди у розмірі 1,4 млн грн за безперешкодне користування землею площею понад 300 га (ч. 5 ст. 27, ч. 4 ст. 368-3 КК України).

Досудове розслідування здійснюється у взаємодії з ГУНП, УСБУ, БЕБ та УСР у Житомирській області.

Corruption schemes, land fraud and embezzlement of budget funds - in Zhytomyr region prosecutors notified of suspicion 28 persons. Damages to the state over UAH 33 million

Under the procedural supervision of the prosecutors of the Zhytomyr Regional and District Prosecutor's Offices, 28 persons from among local self-government bodies, municipal institutions, enterprises and contracting organizations were notified of suspicion. Among the suspects:

- The former head of the State Land Agency in the Kirovohrad region, directors of Collective agricultural enterprise «Ksaverivske», Collective agricultural enterprise «Barvinkivske» and «Barvinkivske» LLC, and 4 other accomplices who misappropriated of 152 plots of land of the Malyn and Chopovytska communities with a total area of 1,747 hectares, worth UAH 15.5 million;

- Head of the Zhytomyr City Council and directors of «Zhytomyrvodokanal» ME and «Zvyagelvodokanal» ME, who overestimated the cost of purchasing electricity in the amount of UAH 6.9 million;

- Head of the department of the Oliivka village council, due to whose actions 3 plots of land with a total area of 3.5 hectares were illegally transferred into ownership, causing damage of UAH 5.3 million;

- Deputy of the Zhytomyr City Council, who did not declare property worth UAH 4.8 million;

- Directors of the lyceum and LLC (contractor), who during the overhaul of part of the lyceum building of the Ovrutskа community misappropriated UAH 1 million;

- Former director of the branch of «State Food and Grain Corporation of Ukraine» Chernyakhiv elevator» JSC, which misappropriated of sunflower grain in the amount of UAH 913 000;

- Four employees of «Kombinat «Record» SE, who fictitiously registered employees and misappropriated of the company's funds in the amount of UAH 835 000;

- Head of the department of the Stanyshivka village council, whose official negligence in the disposal of forest fund lands led to losses in the amount of more than UAH 600 000;

- Director of the LLC (contractor), who misappropriated of UAH 620 000 of budget funds when installing windows in a pre-school education institution and legalized budget funds in the amount of UAH 400 000 when replacing windows in a professional construction lyceum;

- Director of «Zvyagelservice» ME, who embezzled UAH 366 000 during the repair of the city cemetery;

- The head of the Golovkivka village council, which entered false information into the lease agreement for a plot of land with an area of 100 hectares, worth UAH 436 000;

- General Director of «Korosten City Hospital» ME, who misappropriated UAH 434 000 of state funds from the National Health Service as compensation for the treatment of patients after strokes;

- An official of the Malyn City Council, who demanded and received UAH 35 000 for non-interference in the legal activities of the private entrepreneur regarding the removal of forest plantations.

- Two directors of an LLC (contractor) who misappropriated UAH 400 000 during the reconstruction of a kindergarten in the village of Chopovychi

Within the framework of criminal proceedings, damages of more than UAH 33 million, almost UAH 5 million – value of undeclared property, UAH 400 000 – legalized budget funds were established.

The actions of the suspects are qualified under part 4 of Art. 190, part 2, 4, 5 Art. 191, part 1 of Art. 209, part 1, 2 Art. 364, part 1 of Art. 366, part 2 of Art. 366-2, part 1, 2 Art. 367, part 3 of Art. 368 of the Criminal Code of Ukraine.

Prosecutors are preparing motions for the selection of preventive measures and the suspension of suspects from their positions. Measures are being taken to compensate for the damage caused.

In addition, an indictment was sent to trial against three persons – deputy directors of a private enterprise from the city of Dnipro and acting director of a state-owned enterprise in Zhytomyr Oblast. They were detained while receiving an unlawful benefit of UAH 1.4 million for the unhindered use of land of more than 300 hectares (part 5, Art 27, part 4, Art 368-3 of the Criminal Code of Ukraine).

The pre-trial investigation is carried out in interaction with the Main Department of National Police, Security Service of Ukraine Department, Economic Security Bureau and Strategic Investigations Department in the Zhytomyr region.
