The pre-trial investigation established that a resident of Kharkiv developed a plan for the illegal acquisition of a share of a foreign founder in the authorized capital of the enterprise.
To implement the "scheme," he used forged documents, including powers of attorney and acts of acceptance-transfer of the share, which imitated the will of the legitimate owner.
The man submitted them to the state registrar to make changes to the Unified State Register of Legal Entities.
As a result of the actions taken, the right of ownership to 46.2% of the share of the authorized capital of the company was illegally acquired, which in monetary terms amounts to over 8.4 million hryvnias. Thus, significant material damage was caused to the legitimate owner — a foreign citizen.
The state registrar, who carried out the specified actions based on forged documents, had no legal grounds for their execution. By orders of the Ministry of Justice of Ukraine, these entries in the register were canceled.
Under the procedural guidance of the Kharkiv Regional Prosecutor's Office, the state registrar was notified of suspicion of abuse of power for the purpose of obtaining illegal benefits, which caused serious consequences for certain citizens (part 3 of Article 365-2 of the Criminal Code of Ukraine). The resident of Kharkiv is charged with the illegal acquisition of the property of the enterprise, including the share of its founder, by committing transactions using forged documents, which caused significant damage, by prior conspiracy of a group of persons (part 3 of Article 206-2 of the Criminal Code of Ukraine).
The pre-trial investigation is being conducted by investigators of the Main Investigation Department of the National Police in the Kharkiv region. Operational support is provided by the 7th Department (servicing the Kharkiv region) of the Criminal Investigation Department of the National Police of Ukraine.
Note: according to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
