За процесуального керівництва прокурорів Офісу Генерального прокурора повідомлено про підозру трьом особам, які намагалися заволодіти земельною ділянкою площею понад 1 га у центрі столиці. Вона перебуває у власності Київської міської ради та належить до території державного підприємства «Національна кіностудія художніх фільмів імені Олександра Довженка».

За даними слідства, підозрювані реалізовували схему із використанням підроблених документів. Вони виготовили довідки, технічні паспорти та проєкт землеустрою, зареєстрували право власності на неіснуючу будівлю, а згодом створили нове підприємство, оформили акти приймання-передачі «майна» та залучили підконтрольного інженера-землевпорядника.

Кінцевою метою було укладення договору безоплатної оренди земельної ділянки понад 1 га, ринковою вартістю близько 60 млн грн.

Завдяки пильності представників державного підприємства та своєчасному інформуванню правоохоронних органів реалізувати задум до кінця не вдалося – на земельну ділянку накладено арешт.

Наразі трьом підозрюваним інкриміновано:

• організацію замаху на шахрайство в особливо великих розмірах (ч. 3 ст. 15, ч. 3 ст. 27, ч. 4 ст. 190 КК України);

• підроблення офіційних документів групою осіб (ч. 3, ч. 4 ст. 358 КК України).

Вирішується питання про обрання запобіжних заходів.

Досудове розслідування здійснюють слідчі Головного слідчого управління Нацполіції України за оперативного супроводу Департаменту стратегічних розслідувань НПУ.

Примітка: відповідно до ст. 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду.

Three persons were notified of suspicion for the attempt to misappropriate land on the territory of the film studio named after O. Dovzhenko

Under the procedural supervision of prosecutors of the Prosecutor General's Office, three individuals were notified of suspicion for attempted misappropriation of a land plot of over 1 hectare in the center of the capital. It is owned by the Kyiv City Council and belongs to the territory of the state enterprise "National Film Studio of Feature Films named after Oleksandr Dovzhenko."

Under the procedural supervision of the prosecutors of the Prosecutor General’s Office, three persons who tried to misappropriate a plot of land with an area of more than 1 hectare in the center of the capital were notified of suspicion. The Kyiv City Council owns it and it belongs to the territory of the state enterprise «Oleksandr Dovzhenko National Film Studio of Feature Films».

According to the investigation, the suspects implemented the scheme using forged documents. They produced certificates, technical passports and a land management project, registered ownership of a non-existent building, and later created a new enterprise, issued acts of acceptance and transfer of «property» and engaged a controlled land management engineer.

The ultimate goal was to conclude a contract for free lease of a plot of land over 1 hectare, with a market value of about UAH 60 million.

With he vigilance of representatives of the state enterprise and the timely informing of law enforcement agencies, it was not possible to fully implement the plan –, the land plot is under seizure.

Currently, three suspects have been charged with:

* organization of attempted fraud in particularly large amounts (part 3 of Art 15, part 3 of Art 27, part 4 of Art. 190 of the Criminal Code of Ukraine);

* forgery and use of official documents (part 3, part 4 of Art. 358 of the Criminal Code of Ukraine).

The issue of selection of preventive measures of restraint is being determined.

Pre-trial investigation is carried out by investigators of the Main Investigative Department of the National Police of Ukraine with operational support of the Department of Strategic Investigations of the National Police of Ukraine.
