Прокурорами Київської міської прокуратури за матеріалами УСР в м. Києві повідомлено про підозру у службовій недбалості заступнику директора Департаменту транспортної інфраструктури КМДА.

Його дії кваліфіковано за ч. 2 ст. 367 КК України.

На початку грудня 2023 року у зв’язку із затопленням тунелю між станціями «Деміївська» - «Либідська» та потенційною загрозою виникнення надзвичайної ситуації техногенного характеру, рух поїздів на ділянці між станціями «Либідська» - «Теремки» зупинили. В той час КМДА ухвалила рішення організувати перевезення пасажирів автобусами, які дублюватимуть маршрут зачинених станцій метрополітену.

Закриття станцій метрополітену, внаслідок чого було недоотримано прибутки від перевезення пасажирів та організація дублюючих маршрутів наземного транспорту, коштували бюджету столиці 164 млн гривень. Саме на таку суму спричинено збитки столичній громаді.

Встановлено, що заступник директора Департаменту транспортної інфраструктури, який одночасно є начальником управління дорожньої інфраструктури, не контролював роботу комунального підприємства «Київський метрополітен» з питань, що віднесені до компетенції управління, а також не брав участі в організації робіт з усунення наслідків надзвичайних ситуацій на об’єктах транспортної інфраструктури, що згодом і призвело до тимчасового закриття станцій метрополітену.

Вирішується питання про обрання підозрюваному запобіжного заходу та відсторонення від посади.

Нагадаємо, раніше підозри у службовій недбалості, що призвела до тимчасової зупинки роботи кількох станцій метрополітену, отримали четверо посадовців метрополітену:

- колишній керівник КП "Київський метрополітен» (за даними розслідування, не проводив оцінку ризиків виникнення надзвичайних ситуацій на об'єктах КП, не вживав заходів щодо забезпечення довгострокової служби споруд і запобігання появі їх несправностей);

- директор Департаменту транспортної інфраструктури КМДА (попри обізнаність щодо загрози аварійної ситуації, яка могла призвести до руйнування тунелю, не вжив жодних заходів для її усунення);

- начальник служби колії, тунельних споруд і будівель та головний інженер метрополітену (не проводили огляд тунелів, обстеження та спостереження за ослабленими конструкціями і спорудами). 

Досудове розслідування за процесуального керівництва Київської міської прокуратури та оперативного супроводу УСР в м. Києві ДСР НП України здійснюють слідчі СУ ГУ НП у м. Києві.

Відповідно до ст. 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду.

An official of the Kyiv City State Administration was notified of suspicion for official negligence, which led to the stoppage of part of the “blue line” of Kyiv subway

Prosecutors of the Kyiv City Prosecutor's Office based on the materials of the Strategic Investigations Department in Kyiv notified the deputy director of the Department of Transport Infrastructure of the Kyiv City State Administration (KCSA) of suspicion for official negligence 

His actions are qualified under part 2 of Art. 367 of the Criminal Code of Ukraine.

At the beginning of December 2023, due to the flooding of the tunnel between the stations «Demiivska» - «Lybidska» and the potential threat of a man-made emergency, train traffic on the section between the stations «Lybidska» - «Teremky» was stopped. At that time, the KCSA decided to organize the transportation of passengers by buses that would duplicate the route of closed metro stations.

The closure of metro stations, as a result of which profits from the transportation of passengers and the organization of duplicate routes of land transport were not received, as a result it caused losses to the capital budget of UAH 164 million. This is the amount of losses incurred by the capital's community.

It was established that the deputy director of the Department of Transport Infrastructure, who is also the head of the Highway Infrastructure Department, did not control the work of the municipal company «Kyiv Subway» on issues within the competence of the Department, and also did not participate in the organization of works to eliminate the consequences of emergency situations at transport infrastructure facilities, which later led to the temporary closure of metro stations.

The issue of choosing a preventive measure for the suspect and suspension from office is being determined.

 It is should be recalled that four metro officials were previously suspected of official negligence, which led to the temporary shutdown of several metro stations:

- the former head of "Kyiv Subway»" ME (according to the investigation, he did not assess the risks of emergency situations at the municipal enterprise facilities, did not take measures to ensure the long-term service of buildings and prevent the appearance of their malfunctions);

 - the director of the Department of Transport Infrastructure of the KSCA (despite awareness of the threat of an emergency situation that could lead to the destruction of the tunnel, did not take any measures to eliminate it);

- the head of the track, tunnel structures and buildings service and the chief engineer of the subway (they did not inspect the tunnels, inspect and observe weakened structures and structures).
